AIDS/ HIV 

With AIDS/HIV, there are some specific criteria that must be shown in order for you to be entitled to Social Security Disability benefits or Supplemental Security Income benefits. One common marker that the Administration uses to gauge the severity of an HIV/AIDS diagnosis is the T-helper lymphocyte (CD4) counts.  When the CD4 counts registers below 200/mm3, the susceptibility to opportunistic disease increases. ANXIETY

ARTHRITIS

BIPOLAR

Bipolar Disorder can be a very difficult basis for Social Security Disability entitlement because many mental health providers find it to be an effectively treatable condition. For bipolar disorder to be disabling under Social Security regulations, there must be a full symptomatic picture of both manic and depressive symptoms. In other words, there must be clinical proof of both significant highs and significant lows. Another factor the Administration will consider is the claimant’s response to medication. If the prescribed medication is controlling the bipolar symptoms, it is unlikely that the Administration will deem this person disabled. It is important that an individual treating for bipolar see a psychologist and a psychiatrist on a regular basis. CANCER

Various forms of cancer can be the basis for Social Security Disability entitlement. Often the Social Security Administration requires some type of recurrence or metastatic process to be present in order for an individual to receive Social Security Disability benefits. CHRONIC PAIN SYNDROME

Chronic pain syndrome is sometimes referred to as complex regional pain syndrome, reflex sympathetic dystrophy or chronic myofascial pain syndrome. It is an unusual impairment in the sense that the pain that an individual experiences does not equate with objective medical findings. Chronic regional pain often first develops when there has been a traumatic injury to the bone or soft tissue. Often individuals who suffer from chronic pain syndrome also experience other symptoms like fatigue, weakness and depression.  Social Security Ruling 03-02p provides guidelines for symptoms that the Administration should consider when evaluating chronic pain claims. CONGESTIVE HEART FAILURE

Congestive heart failure or chronic heart failure is a serious cardiac condition in which the heart is pumping at suboptimal levels. The Administration often looks at ejection fraction levels when assessing chronic heart failure. An ejection fraction (“EF”) is the fraction of blood pumped out of a ventricle with each heart beat. While an EF of 70% is a normal output, the Administration looks for an EF of 30% for entitlement purposes. Often patients with congestive heart failure coupled with coronary artery disease will require stents and/or bypass grafts. If this is the case, the Social Security Administration will want a copy of these operative notes.

CROHN’S DISEASE

Crohn’s Disease and other gastrointestinal impairments like regional enteritis, colitis, and irritable bowel syndrome can have disabling symptoms. DEPRESSION

Many people suffer from a form of depression at some point in their lifetime. DIABETES

While a diagnosis of diabetes alone may not necessarily entitle an individual to Social Security Disability benefits, diabetes with complications may certainly fit Social Security’s criteria. In assessing diabetes, the Social Security Administration looks at how the diabetes affects other organs and body systems. The Administration looks to see if peripheral neuropathy is being caused by the diabetes. Is the diabetic claimant feeling numbness and tingling in any of his/her extremities? Additionally, the Administration looks to see if acidosis or retinopathy is developing due to the fact that the diabetes is uncontrolled. If amputation has been necessary, the Administration will want a copy of the operative report. The Administration will also consider whether or not the claimant is following a diabetic diet and taking his/her medications as prescribed. If the claimant is neglecting physician’s order or failing to monitor his/her diabetes, the Administration could use this evidence to make an adverse determination.

EPILEPSY/SEIZURES

FIBROMYALGIA

Fibromyalgia is a widespread pain condition that affects all four quadrants of an individual’s body. HEADACHES

Headaches, particularly migraines, can be the basis of a disability claim, in spite of the fact that the Social Security Administration has never expressly enumerated criteria addressing this neurological impairment. Social Security considers the severity, length and frequency of the headache in evaluating the condition. Particularly important is whether the migraine sufferer gets a warning sign, a regular triggering experience or whether there is anything that can be done to control the migraine. Medications can be a very important factor for the Administration to consider. For instance, if a physician is prescribing Tylenol 3 for a headache and it is controlling the symptoms, it is unlikely that a person is having a true migraine. However, claimants who have been prescribed medications like Topamax, Midrin, Neurontin, and Botox injections, without any real improvement, may be found to have a more severe migraine condition. Documenting the headache occurrences is crucial for entitlement and it is recommended that a headache journal be maintained.

HEPATITIS

Hepatitis and other liver diseases can be the basis for Social Security entitlement. While it is not necessary that an individual be on a waiting list for a liver transplant, it must be shown that that the disease is in a relatively advanced stage. The Administration often uses the laboratory workups is assessing entitlement to disability, with a specific focus on serum bilirubin levels. Other signs the Administration looks for in assessing chronic liver disease cases is esophageal varices, ascites and hepatic cell necrosis. It is important that the liver disease has been confirmed by an actual liver biopsy and that the disease was not diagnosed in a speculative fashion. Treatments, whether it is medications, interferon or an actual transplant, are also weighed by the Administration.

LUPUS

Lupus can be a difficult disease to diagnose due to the fact that it shares many characteristics with other illnesses. The Social Security Administration looks for specific phenomenon in regards to joint, muscle, ocular, respiratory, cardiovascular, digestive, renal, hematological, skin, and neurological involvement. SPINAL IMPAIRMENTS

SCHIZOPHRENIA
